TERMS & CONDITIONS
Booking terms: These Terms and Conditions of hire is between C WISE Property Ltd (“us” , “we”, “our”) and you the person making the booking and you and all adult members of your party who will be staying in any of our accommodation (“you”, “your”, “client”, “the guest”.) By making a booking or staying in one of our accommodations you agree to abide by these terms and conditions.
1. The agreement will be effective from the dates as agreed between the CWISE PROPERTY LTD and the Guest.
2. The Guest will pay us the rent for the entire period in advance. Moreover, a refundable (less any damages, if any) deposit of £100.00, which will be refunded within one week of vacating the premises.
3. The Guest further agrees that the suite/apartment will be used for residential purpose only.
4. The Guest and C WISE PROPERTY LTD agree that in case of any damage to the furniture during the tenancy, the Guest will replace the same. The Guest also agrees that any loss caused to the building or the apartment due to his/her negligence will be fully compensated.
5. You must be 18 years or over when you book your accommodation.
6. We reserve the right to refuse to accept any booking. We accept your booking when we issue a Booking Confirmation email.
7. Smoking is not allowed in the units. A £100.00 penalty will be charged in case of a violation. The same charges will apply for any extra ordinary mess left in the unit.
8. The Guest agrees to vacate the property before the agreed check-out time of 11am. In the case of a violation, a £50.00 penalty will be charged if vacated up to 2 hours after this time, and the full rate for the next night will be charged for anything beyond this, unless otherwise pre authorised by C WISE STAYS .
9. The Guest agrees to pay £30 in the case they lose the key to the property. The Guest is also liable for a £50 call out fee if they get locked out of the premises.
10. Our rates are subject to change without notice unless otherwise agreed by us in writing.
11. The Guest agrees to abide by the rules and regulations of the apartment building. The Guest agrees that in case of any damage to the apartment, premises, the Guest will be liable to pay for the damages. The Guest is also responsible for returning the keys where specified to the designated key box at departure. The Guest agrees that the building management/security may enter the apartment in case of emergency without seeking the Guest’s permission.
12. The Guest agrees to let any officer or staff of C WISE STAYS at reasonable times to enter the premises for inspection.
13. The Guest agrees that C WISE STAYS or any of its staff will not be responsible for any damages which may include theft, fire, personal injury, death or any other damage to the vehicle and personal belongings of the guests and their visitors. It is the responsibility of the Guest to ensure that they have adequate and relevant insurance coverage before occupancy. The Guest will also ensure that their vehicles are comprehensively insured.
14. The Guest also gives permission for the housing keeping staff to enter the premises for the purpose of housekeeping.
15. The Guest also agrees that no illegal activity will take place in the premises.
16. Guest should not participate in film or photography that is intended for commercial use or profit, without documented permission from C Wise Stays.
17. The Guest agrees that there will be no disturbance to the neighbours.
18.The Host shall not be responsible for any accident or injuries occurring to the Guest, or guests of the Guests, on this property or premises.
19. All our properties are strictly no party venues.
20. Stricly NO PETS allowed in the apartment.
21. All apartments are occupied as serviced apartments and are only to be used as temporary or holiday accommodation for you, or your organization. They are not for use as the principal, additional home or residence of guests; you will not be entitled to a tenancy or an assured shorthold or assured tenancy. No relationship of landlord and tenant is created and no statutory security of tenure exists now or when the period of occupation ends. If you or any member of your party fails to vacate at the end of the period, you will be charged the appropriate accommodation charges for the continued period of occupation. No persons other than the guests have the right to use the apartment.
These conditions constitute an excluded agreement under S(3A)(7)(a)of the Protection from Eviction Act 1977 (as amended) and cannot be construed as an assured tenancy under the Housing Act 1988 (as amended).
We cannot guarantee an exact apartment number prior to arrival.
The maximum guests in an apartment is determined by the number of beds in the apartment. If the maximum number is exceeded then we, or the preferred supplier, may refuse access to the accommodation and/or reserve the right to charge for additional apartments.
22. EXTENSIONS: If you wish to extend a stay, please give us as much notice as possible in order to facilitate your request. All extensions are subject to availability and rate change.
CANCELLATION POLICY
23. We shall not be liable for changes, cancellations or any other effect on your booking due to events beyond our control (Force Majeure). In these conditions “force majeure” means any event or consequences thereof which could not have been reasonable avoided by us even with the exercise of all due care. Such event may include war or threat of war, civil strife, terrorist activity, industrial dispute, natural or manmade disaster, fir, adverse weather condition and all similar events outside our control.
23.1 C WISE STAYS reserves the right to treat an early departure or reduction in the number of nights or apartments booked as a cancellation and apartments may be re- let and cancellation charges will apply.
Non-arrivals will be treated as a cancellation and you will not be entitled to any refunds. Please note that transaction fees are not refundable in the event of a cancellation.
If you need to cancel your booking, you are entitled to do so with no charge providing cancellation in writing (e-mail is acceptable to contact@cwisepropertyltd.co.uk )has been received as follows: -
28 days’ minimum notice is the cancellation we require as minimum notice. For extensions or early departure, we also require a minimum 28 day’s notice, otherwise your apartment is not guaranteed.
Bookings are not transferrable to different dates and should this notice not be adhered to charges will apply as per the notice received. Once in-house, if you wish to leave earlier than originally booked, you will need to offer 28 days’ notice.
BY AGREEING TO THIS SUB LEASE AGREEMENT, THE GUEST AGREES TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS AND AGREES THAT THESE TERMS CONSTITUTE A BINDING CONTRACT BETWEEN THE GUEST AND C WISE PROPERTY LTD.
